Welcome to Latinart Studios . By engaging our services, accessing our website, or using any of our digital solutions, you agree to our standard Terms and Conditions.
1. Scope of Services and Engagement Models
LatinArt Studios provides professional services including web design, digital marketing, content creation, branding, and advertising campaign strategies. Each service operates under the following specific conditions:
Web Design and Development: A 50% deposit is required to start any project. The remaining 50% may be paid before delivery or financed through installment options or specific add-ons enabled on our platform such as Growth Plan.
Content Creation: We offer monthly, annual, and 3-month commitment plans. Monthly-to-monthly plans include a one-time, non-refundable setup fee.
APEX Content Creation (Annual Plan) guarantees a minimum of 2 million views. This high-traffic volume is strategically designed to drive significant business growth and lead generation even at a conservative 1% engagement rate, this equates to 20,000 potential leads. Because of this massive reach, before officially moving forward with the APEX plan, we work closely with our clients to evaluate their infrastructure, ensuring their systems are fully prepared to handle over 20,000 leads and offering complementary services to help scale, refine, and support their infrastructure as they grow.
Branding and Graphic Design: Pricing and scope are custom-quoted based on each client's specific requirements, as defined in a proposal or prior written agreement.
Paid Ads Management: Clients pay their ad spend directly to platforms (e.g., Meta, Google. LatinArt Studios charges a management fee structured as follows: a flat rate of $1,700 USD for monthly ad investments up to $7,000 USD, and for budgets exceeding $7,000 USD, a $1,700 USD base plus 13% on the incremental spend.
Marketing Strategy Campaigns: We offer two (2) strategy options. A 50% payment is required at the start, with the remaining 50% due one month later. Strategies are developed and delivered formally within a maximum of 2 to 3 months from the project start date.
2. Payments, Billing, Cancellations, and Refund Policy
Setup Fees: All initial setup fees and onboarding configuration charges are strictly non-refundable, as they cover immediate resource allocation and initial agency labor.
100% Satisfaction Policy: Under our satisfaction policy, clients are eligible for a refund if they did not receive what was originally agreed upon or if we failed to meet the agreed-upon timeframe.
Cancellation Mid-Project: If a client chooses to cancel a project or service for reasons outside of our guaranteed scope before its completion, no refunds will be issued for work already executed. However, we assess all cases in good faith: the client may retain rights to certain materials, progress, or specific deliverables at our sole final discretion and upon written notice.
Right of Refusal and Discontinuance: We reserve the right to refuse or terminate service at any stage if a client's content, branding, or business practices violate human rights, promote discrimination, or conflict with our core values, as determined at our sole discretion. Upon termination under this provision, work ceases immediately, no incomplete files or assets will be delivered, and unused funds for unrendered services will be refunded. We accept no liability for any direct, indirect, special, or consequential losses resulting from such cancellation.
Subscription Terms: Monthly subscriptions or recurring plans must be paid by the established due dates. Failure to pay may result in temporary suspension of services or access until the account is brought current.
3. Intellectual Property
Transfer of Rights: Intellectual property rights regarding developed websites, branding, designs, or multimedia content are transferred to the client only once the total payment for the project or service is settled in full (100%).
Portfolio Usage: LatinArt Studios reserves the right to use completed projects, designs, websites, and content pieces as part of its commercial portfolio, case studies, or promotional materials, unless otherwise agreed upon in writing.
Third-Party Provider Outages: We are not responsible for service interruptions, server downtime, technical failures, or errors originating from third-party providers, such as payment gateways, hosting platforms, or integrated external tools.
Third-Party Algorithms and Platforms: Digital marketing, SEO, local optimization, and advertising services are subject to the policies, algorithm updates, and terms of service of external platforms (Google, Meta, Apple, etc.). We do not guarantee exact sales results, fixed conversion metrics, or specific search rankings due to the volatile nature of these ecosystems. Sole Exception: The performance guarantees explicitly stated under the APEX Content Creation Annual Plan—minimum delivery of 2 million views—remain fully applicable.
Technical Failures: We are exempt from liability for indirect damages, temporary data loss, or service interruptions resulting from connectivity issues or user misuse.

These Terms and Conditions are governed by the laws of the State of Minnesota. In the event of any disagreement, both parties agree to first work together in good faith to resolve the matter amicably. Any legal disputes arising from or relating to these terms will be handled exclusively in the competent state or federal courts located within the State of Minnesota, and both parties hereby consent to the personal jurisdiction of such courts.
